The ICC statement said that the date of hearing those arguments will be announced later. Kony, who is 63 years old, has been wanted by the court based in The Hague since 2005.
He is wanted on suspicion of war crimes and crimes against humanity following three decades of brutality by his rebel group Lord's Resistance Army - LRA in several African countries.
The ICC announced six months ago that it will hold hearings this October to confirm 36 charges against Kony, whose whereabouts are currently unknown.
Led by underground warlord Joseph Kony, the LRA terrorized Ugandans for nearly 20 years fighting President Yoweri Museveni's government from bases in northern Uganda and neighboring countries. The militants have been largely destroyed, but Kony remains one of the ICC's most wanted fugitives.
The Christian and terrorist group LRA was founded by the Catholic Joseph Kony three decades ago where Kony also called himself a prophet.
Reports indicate that the group killed more than 100,000 people and kidnapped 60,000 children who were forced to become sex slaves by soldiers in the war.
