The ongoing hearing in the Supreme Court of India regarding Article 370 has been completed. The Supreme Court has reserved its decision. According to the received reports, the ongoing hearing in the Supreme Court on the petitions challenging the decision of the Modi government to remove Article-370 from Indian-administered Kashmir has been completed. This hearing lasted for 16 days. The petitioners demand that Article 370 should be reinstated in Jammu and Kashmir and its full statehood should also be returned. A five-judge constitution bench headed by the Chief Justice heard the petitions related to Article 370.

It included Chief Justice DY Chandrachud, Justice SK Kaul, Justice Sanjiv Khanna, Justice BR Gavai and Justice Suryakant. Senior advocates Kapil Sibal, Gopal Subramaniam, Rajiv Dhawan, Zafar Shah, Dushyant Dave gave their opinion in favor of restoring Article 370. At the same time, Attorney General R Venkataramani, Solicitor General Tushar Mehta, Senior Advocates Harish Salve, Rakesh Dwivedi, V Giri supported the Central Government and justified the decision to remove Article 370. On the last day of the hearing, the Supreme Court said that if the petitioner or the respondent party wants to say something in writing, it can be done for the next three days. The lawyers for both the sides argued different issues in the 16-day hearing.

It discussed whether the decision taken by the Central Government in the year 2019 has constitutional validity or not. In this, the petitioners said that Article 370 could have been removed only by the Constituent Assembly. At present President's rule is in force in the state, it was also challenged. On this, the Supreme Court asked the government whether the Parliament could have partitioned Jammu and Kashmir during the President's rule? Explain that Article 370 of the Constitution used to give special status to the erstwhile state of Jammu and Kashmir, which was abolished by the Modi government at the Center on August 5, 2019. Along with this, Jammu-Kashmir and Ladakh were divided into two parts. Both have been made separate union territories. The central government says that in the future, Jammu and Kashmir will be made a full-fledged state again. (RZ)
